Privacy Policy

This Privacy Policy ("Policy") is an integral part of the YOYO CARS LIMITED User Agreement & Privacy Policy.

8 Introduction & Binding Acceptance

YOYO Cars Limited ("YOYO CARS," "we," "our," or "us"), acting as the data controller, operates from North Park Plaza, Bweyogerere, Mbalwa Road, P.O. Box 173011, Kampala, Uganda.

By using the Platform, you irrevocably and unconditionally consent to the data collection, use, sharing, and retention practices described herein. This Policy is designed to protect the operational integrity of the Platform and to define the limits of our responsibility. If you do not agree with every provision of this Policy, you are strictly prohibited from accessing or using the Platform and must terminate your account immediately.

9 Information We Collect: An Absolute Right

YOYO CARS collects information that is critical for the operation, safety, and security of the Platform. You acknowledge our unfettered right to collect, and your obligation to provide, the following:

Personal Identification Information

Your full legal name, email address, date of birth, photograph, National ID number and copy, Driver's License details, and your exact Uganda-registered phone number. This information is mandatory. YOYO CARS will not be able to provide you with services if this required information is not provided.

Vehicle Information

For Drivers, vehicle registration details, license plate, photos, insurance information, and details about your car(s).

Financial Information

Details of accounting or financial transactions, including trip payments, and in-app wallet balances.

All financial transactions are irrevocably tied to your registered phone number as per Clause 2.6 of the Terms of Use.

Technical & Usage Data

IP address, login information, browser type, operating system, page interaction details, and the resources you access. We also collect precise Geolocation Data continuously when the App is running. This is mandatory for the Service to function and cannot be disabled without terminating your account.

Trip & Communications Data

A record of any bookings you've made or trips you've provided, your responses to surveys or questionnaires (e.g., reviews), and a record of any correspondence between you and us. We may record phone calls with our customer service for quality assurance and training, and we will notify you at the beginning of the call.

10 How We Use Your Information: Broad Operational Purposes

You consent to us using your information for the following broad purposes, which are essential to our business model:

  • To Provide and Maintain the Service: To carry out our obligations from any contracts between you and us, including user verification, facilitating connections, processing payments, and enabling real-time tracking.
  • For Safety, Security, and Fraud Prevention: To ensure compliance with our Terms and Conditions, to fight against fraud, and to keep our Platform safe and secure. This includes scanning messages exchanged on the Platform to prevent circumvention of our systems and to detect prohibited conduct.
  • For Customer Support and Dispute Resolution: To give you access to our customer support, handle your inquiries, and resolve any disputes solely at our discretion.
  • For Network and Platform Integrity: To administer our Platform for internal operations, including troubleshooting, data analysis, testing, and research, and to improve our Platform to ensure that content is presented in the most effective manner.
  • For Legal and Regulatory Compliance: To comply with all applicable Ugandan laws, regulations, court orders, and government requests.
  • For Business Purposes: To measure the effectiveness of advertising, deliver relevant advertising, and for other legitimate business interests, for which you expressly waive any right to object.

11 Sharing of Information: Unrestricted Right to Disclose

YOYO CARS reserves the absolute right to share your information with third parties without further notice or consent, and you hereby provide your irrevocable and blanket consent for such disclosures.
  • With Other Users: Necessary information (e.g., Driver's name, vehicle details, and live location to Passenger; Passenger's name and pick-up location to Driver) is shared to facilitate the trip. Your phone number is shared with the members you will share a ride with.
  • With Service Providers: We share data with trusted vendors who assist our operations (e.g., payment processors, cloud hosting, identity verification, analytics). These partners are bound by strict agreements that protect us.
  • For Legal Reasons & Law Enforcement: We will, without hesitation, disclose any and all information to courts, law enforcement, government agencies, or other parties where we believe in good faith it is necessary to (i) comply with the law, (ii) respond to claims, (iii) enforce our agreements, (iv) protect the rights, property, or safety of YOYO CARS, our Users, or the public, or (v) participate in an investigation.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as a business asset.

12 Data Security: No Liability Assumed

While YOYO CARS implements commercially reasonable security measures, you expressly acknowledge and agree that:

  • No method of transmission over the Internet or electronic storage is 100% secure.
  • WE CANNOT AND DO NOT GUARANTEE THE ABSOLUTE SECURITY OF YOUR DATA.
  • You transmit all information at your own risk.
  • YOYO CARS shall under no circumstances be held liable for any unauthorized access, use, or destruction of your data.

13 Data Retention: Indefinite Retention for Legal & Business Needs

We will retain your personal data for as long as your account is active.

Crucially, even after you terminate your account, we will retain your personal information for as long as necessary to comply with our legal and regulatory obligations under Ugandan law (e.g., tax, financial reporting). Financial data will be retained for the period required by applicable laws (e.g., up to 10 years).
  • Resolve disputes and enforce our agreements.
  • Prevent fraud and ensure users who have violated our terms do not circumvent our rules. In cases of suspension, data may be retained for 2 to 10 years.
  • Conduct internal business analysis and for archival purposes. We may archive some of your personal data for a period not exceeding 5 years to manage potential disputes.
This retention period may be indefinite where required by law or compelling business need, and you waive any right to demand erasure of such data.

14 Your Rights (Limited by Our Policy)

Under the Data Protection and Privacy Act, 2019, you may have certain rights regarding your data. However, the exercise of these rights is subject to significant limitations and our overriding business and legal interests:

Right to Access & Correction

You may request access to or correction of your data. We will comply where feasible, but we are not responsible for inaccuracies in data you provided.

Right to Object

You may object to certain processing. However, by using the Platform, you have already given irrevocable consent for the critical processing activities outlined in this Policy. Objecting to such processing will necessitate the immediate termination of your account.

Right to Erasure (Deletion)

You may request account deletion. This will be treated as an account termination. Please note Clause 13 of this Policy: We retain the right to keep your data after deletion for our legal and business purposes.

All requests to exercise your rights must be submitted in writing to privacy@yoyoservices.com. We will respond at our discretion and in accordance with Ugandan law. We may charge a reasonable fee for repetitive or manifestly unfounded requests.

15 International Data Transfer

Your data may be processed on servers located outside of Uganda. By using the Platform, you consent to the transfer, storage, and processing of your data in any country where we have facilities or engage service providers. You acknowledge that the data protection laws of these countries may differ from those of Uganda.

16 Cookies and Tracking Technologies

We use cookies and similar tracking technologies to track activity on our Platform and hold certain information. You can instruct your browser to refuse all cookies. However, if you do not accept cookies, you may not be able to use some portions of our Service.

17 Changes to This Policy

YOYO CARS reserves the exclusive and absolute right to modify this Policy at any time. We will notify you of changes by updating the "Last Updated" date. Your continued use of the Platform after any modification constitutes your binding and irrevocable acceptance of the revised Policy.
